  11. RIVERBANK COMPUTING LIMITED LICENSE AGREEMENT FOR SIP 4.9

  13. 1. This LICENSE AGREEMENT is between Riverbank Computing Limited
  14. ("Riverbank"), and the Individual or Organization ("Licensee") accessing
  15. and otherwise using SIP 4.9 software in source or binary form and its
  16. associated documentation.  SIP 4.9 comprises a software tool for
  17. generating Python bindings for software C and C++ libraries, and a Python
  18. extension module used at runtime by those generated bindings.

  20. 2. Subject to the terms and conditions of this License Agreement, Riverbank
  21. hereby grants Licensee a nonexclusive, royalty-free, world-wide license
  22. to reproduce, analyze, test, perform and/or display publicly, prepare
  23. derivative works, distribute, and otherwise use SIP 4.9 alone or in
  24. any derivative version, provided, however, that Riverbank's License
  25. Agreement and Riverbank's notice of copyright, e.g., "Copyright (c) 2009
  26. Riverbank Computing Limited; All Rights Reserved" are retained in
  27. SIP 4.9 alone or in any derivative version prepared by Licensee.

  29. 3. In the event Licensee prepares a derivative work that is based on
  30. or incorporates SIP 4.9 or any part thereof, and wants to make
  31. the derivative work available to others as provided herein, then
  32. Licensee hereby agrees to include in any such work a brief summary of
  33. the changes made to SIP 4.9.

  35. 4. Licensee may not use SIP 4.9 to generate Python bindings for any
  36. C or C++ library for which bindings are already provided by Riverbank.

  38. 5. Riverbank is making SIP 4.9 available to Licensee on an "AS IS"
  39. basis.  RIVERBANK MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR
  40. IMPLIED.  BY WAY OF EXAMPLE, BUT NOT LIMITATION, RIVERBANK MAKES NO AND
  41. DISCLAIMS ANY REPRESENTATION OR WARRANTY OF MERCHANTABILITY OR FITNESS
  42. FOR ANY PARTICULAR PURPOSE OR THAT THE USE OF SIP 4.9 WILL NOT
  43. INFRINGE ANY THIRD PARTY RIGHTS.

  47. AS A RESULT OF MODIFYING, DISTRIBUTING, OR OTHERWISE USING SIP 4.9,

  51. breach of its terms and conditions.

  54. relationship of agency, partnership, or joint venture between Riverbank
  55. and Licensee.  This License Agreement does not grant permission to use
  56. Riverbank trademarks or trade name in a trademark sense to endorse or
  57. promote products or services of Licensee, or any third party.
